Distance agreement

This Distance Contract (hereinafter – the Contract) contains the pre-contractual information required by law, which is provided to the Customer before entering into a distance contract (an order on the Website), in accordance with Cabinet Regulation No. 255 of 20 May 2014 “Regulations on Distance Contracts” and the Consumer Rights Protection Law of the Republic of Latvia.

2. Subject Matter of the Contract
This Contract sets out the terms under which SIA AmaNORD (hereinafter – the Seller) sells and delivers products to a natural person acting for purposes outside their trade, business, or profession (hereinafter – the Consumer, the Customer), using the Website.
The Seller offers both products individually made to the Customer’s specification (for example, ceramic tiles) and ready-made products available for immediate purchase.
3. Main Characteristics of the Product
The main characteristics, description, images, and price of each product are indicated next to the product on the Website. For made-to-order products, the specific specification is agreed individually with the Customer before the order is confirmed.
The actual colour, texture, or size may differ slightly from what is depicted, as this is characteristic of ceramic material and the handcraft process. Such natural variations are not considered a non-conformity of the product.
4. Total Price and Additional Costs
- The final price of the product, including value-added tax (VAT), is displayed on the Website already in the product catalogue and on the product page, and is visible to the Customer before placing an order.
- The Customer pays the full price for the ordered product on the Website at the time the order is placed.
- Shipments to countries outside the European Union may be subject to additional customs procedures, customs duties, value-added tax (VAT) in the destination country, and other fees related to international shipping. As the amount of these costs only becomes known after the shipment has been dispatched and delivered, the Customer may receive an additional invoice after receiving the shipment for the actual costs incurred, which the Seller is unable to determine precisely at the time the order is placed.
- Delivery costs (if any) are indicated before the order is confirmed.
5. Payment, Delivery, and Performance
Payment is made through the payment system available on the Website at the time the order is placed.
Delivery of products is carried out by an external delivery company (courier service). Delivery times are agreed at the time the order is placed and may vary depending on the destination and the production time required for made-to-order products.
If the Seller is unable to fulfil the order within the agreed timeframe, the Seller will notify the Customer and offer a new performance date or refund the amount paid if the Customer does not agree to it.
6. Moment of Conclusion of the Contract
The distance contract between the Seller and the Customer is deemed concluded at the moment the Customer receives the Seller’s confirmation of acceptance of the order (for example, by email), not at the moment the Customer submits the order.
7. Right of Withdrawal
General 14-Day Period
If the product is a ready-made, in-stock item, the Customer has the right to withdraw from the Contract within 14 (fourteen) calendar days from the date of receiving the product, without giving any reason.
To exercise the right of withdrawal, the Customer must clearly inform the Seller using the contact details in Section 1, or by using the withdrawal form template attached as an annex to this Contract. The withdrawal period is deemed to have been observed if the notice of withdrawal is sent before the deadline expires.
If the Customer exercises the right of withdrawal, the product must be returned to the Seller no later than 14 days from the date the withdrawal is notified. The direct costs of returning the product are borne by the Customer, unless otherwise agreed with the Seller.
The Seller will refund the amount paid by the Customer (excluding additional costs arising from the Customer’s choice of a delivery method other than the cheapest standard delivery method offered by the Seller) no later than 14 days from the date the withdrawal notice is received, but not before the Seller has received the product back or the Customer has provided proof of having sent the product.
Exceptions to the Right of Withdrawal
Under the Consumer Rights Protection Law and Cabinet Regulation No. 255, the right of withdrawal does not apply to goods manufactured according to the consumer’s specifications or which are clearly personalised. As the Seller’s made-to-order products (for example, custom-made ceramic tiles) are manufactured according to the Customer’s specifications, the right of withdrawal does not apply to such products, except where a manufacturing defect is identified.
The Customer is informed at the time of placing the order whether a specific order is considered a made-to-order (personalised) product.
8. Non-Conformity of Products and Handling of Complaints
If the delivered product is damaged, incomplete, or does not match the order, the Customer must notify the Seller within 5 (five) days of receiving the product, attaching photographic evidence. Complaints submitted after this deadline may not be considered by the Seller.
The Seller will review each complaint submitted within the deadline and provide the Customer with a response within no more than 15 days, offering a solution – repair, replacement, price reduction, or appropriate compensation.
Products are covered by the statutory conformity guarantee set out in the Consumer Rights Protection Law. The warranty does not cover damage resulting from improper use, wear and tear, or improper installation, nor natural material characteristics that are not considered a defect.
9. Out-of-Court Dispute Resolution
If the Customer believes that the Seller has infringed their rights, the Customer may submit a complaint to the Seller using the contact details in Section 1.
If the dispute is not resolved through mutual negotiation, the Customer, as a consumer, has the right to contact the Consumer Rights Protection Centre (PTAC, www.ptac.gov.lv) or use the European Commission’s Online Dispute Resolution (ODR) platform.
10. Data Processing
The processing of personal data in connection with the conclusion and performance of the Contract is carried out in accordance with the Seller’s Privacy Policy, available on the Website.
11. Final Provisions
This Contract and the relationship between the Parties are governed by the laws of the Republic of Latvia.
The Seller reserves the right to amend this Contract and its annexes. Amendments do not apply to orders confirmed before the amendments take effect.
